Terms & Conditions
1. THE PROMOTIONAL COMPETITION
1.1. The name of the Promotional Competition is Sea Harvest 10th GEN IPADS Back to School Year of The Fish Finger Competition 2025 (hereinafter the “Competition”).
1.2. The following terms and conditions apply exclusively to this Competition. Participation in the Competition constitutes the Participant’s acceptance of these terms and conditions.
2. THE PROMOTER
2.1. The Promoter is Sea Harvest South Africa, a company incorporated in the Republic of South Africa and having its registered address at 1st Floor, Block C, Boulevard Office Park, Searle Street, Woodstock, 7925; (hereinafter “the Promoter”).
3. THE COMPETITION PERIOD
3.1. The Competition start date is on 28th January 2025 at 00h00 (GMT+2) and will end on 28th February 2025 at 23h59 (GMT+2) (hereinafter the “Competition Period”).
3.2. No entries outside of the Competition Period will be accepted.
4. PARTICIPANTS IN THE COMPETITION
4.1. The Competition is open to all students in the participating schools who are in possession and able to present original, valid and lawful proof of identification.
4.2. This competition is not open to any juristic entities.
4.3. Competition is only valid within South Africa. Participants must be in South Africa at the time of entering the Competition, and at the time of the prize being awarded and delivered, should they be declared a final Winner, failing which such person will be disqualified and the Promoter reserves its right to draw a new finalist to be declared a winners, subject to the terms as set out herein.
4.4. The Competition will be managed in accordance with the provisions of the Consumer Protection Act,68 of 2008 (as amended). Participants agree to cooperate with the Promoter, including providing any necessary documents and fulfilling requests as required by applicable legislation, regulations, and the competition rules.
4.5. All personal information provided by Participants will be processed in accordance with applicable South African data protection legislation.
4.6. By entering this Promotional Competition, Participants hereby consent to the processing of their personal information for the purposes of this Promotional Competition. Participants agree to hold the Promoter, its agents and suppliers harmless from any unintended disclosures of such information to unauthorised parties.
4.7. Participants acknowledge that any information supplied to Promoter, its agents and suppliers in terms of these Terms and Conditions is provided voluntarily and with the necessary consent.
4.8. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 (the “Act”), and including applicable data privacy laws.
4.9. Participants accept that the Promoter or its suppliers, agents who in some instances may reside outside the Republic of South Africa, may collect or process personal information of Participants.
5. HOW TO ENTER THE COMPETITION & SELECTION OF WINNERS
5.1. Participants may have the opportunity to win 1(ONE) of 5 (FIVE) 10th Generation iPad 64GB excluding software, accessories, up to a value of R8,000.00 (EIGHT THOUSAND RAND) each. Any items or services not explicitly mentioned in the prize are excluded from the prize. Colours of the iPads are subject to available stock.
5.2. To enter, Participants must scan the campaign QR code and fill in the entry form.
5.3. No purchase is required for entry.
5.4. Participant/s are responsible for data rates and network charges according to their service provider/s terms and conditions.
5.5. Participants must provide correct and accurate contact details.
5.6. Entries, which are including but not limited to be deemed fraudulent, unclear, illegible, or submitted via an incorrect entry mechanism or contain errors will be declared invalid.
6. DELIVERY OF THE PRIZE/S
6.1. The prize will be delivered to the declared winner, subject to successful verification as per the rules set out herein. Delivery shall occur within 4 (FOUR) weeks following the successful verification and final declaration of the winner(s). Any delay in delivery shall be communicated to the winner(s) to facilitate appropriate arrangements.
6.2. Any prize not taken up for any reason within 30 (THIRTY) days of notification, successful verification and confirmed delivery date will be forfeited and the Promoter reserves its right to select an alternate winner, in terms of the rules as set out herein.
6.3. An eligible Winner will be required to provide proof of purchase, valid proof of identification, physical delivery address, including their full name, contact number, and e-mail address, as well as any other information as may be required for the Promoter to carry out prize verification, acceptance and delivery.
6.4. Prizes are not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner in accordance with the rules as set out herein.
6.5. All risk of the prizes shall pass to the winners on delivery.
6.6. The Promoter reserves the right, at its sole discretion, to or substitute the prize with any other prize of comparable commercial value for whatsoever reason.
6.7. Any expenses incurred by winner/s, other than the items listed in the prize will be for the winner/s own account.
6.8. The Promoter, its agents and suppliers do not warrant that any prize will be free from defects. the Promoter and/or its directors, members, partners and employees shall not be liable in any way whatsoever for any loss, damage or costs, howsoever arising, suffered by a winner of any of the prizes and/or its use and/or in participating in this promotional competition.
6.9. The cost of presenting proof of purchase and entering the promotion, as well as any network charges that apply, will be borne by the winner in accordance with the tariff rates set by the winner’s mobile network provider.
7. SELECTION OF WINNERS AND NOTIFICATION
7.1. Participants will only be eligible to win once during the entire Competition Period.
7.2. A Participant who has previously won a prize in any competition run by the Promoter in the last 3 (THREE) months shall not be eligible to win a prize in this competition.
7.3. Finalists will be drawn from a random audited draw within 4 (FOUR) weeks from competition period close. Finalists will be selected randomly from all eligible entries received during the Competition Period and will be subject to verification to be declared a final winner.
7.4. Finalists will be informed telephonically either directly by the Promoter or its authorised agents within 3 (THREE) working days after his/her name has been drawn, that he/she has been selected as a finalist, subject to verification to be declared a final winner. Should there be no successful contact with the selected winners over the 3 (THREE) day period, the Promoter reserves its right to proceed and select new backup winners.
7.5. Calls may be recorded for security and verification purposes.
7.6. Winners have 5 (FIVE) business days from being contacted to submit their identification and any other required verification documents as may be requested to claim their prizes, failing which prizes will be forfeited and a new finalist may be selected.
8. GENERAL
8.1. Artwork and prize visuals on any competition and/or promotional materials are for illustrative purposes only.
8.2. All entrants to this promotional competition participate entirely at their own risk. The Promoter, it agents and suppliers shall not be liable for any loss or damage, whether direct, indirect, consequential, or otherwise, arising from any cause whatsoever, which may be suffered by the entrants in connection with this competition or the use of the prizes.
8.3. Any violation or attempt to violate any of the competition rules will result in the immediate disqualification of the alleged transgressor.
8.4. The Promoter reserves the right to disqualify any participant who enters including but not limited to using false information by robotic, automated or like means.
8.5. The Promoters reserve the right at any time, without notice, to amend, modify, or change these rules and any prizes, and to postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason which the Promoters reasonably deem necessary and all entrants agree to waive any rights that they may have in terms of this competition and acknowledge that they will have no recourse against the Promoter or its agents or distributors.
8.6. The Promoter, its agents and suppliers are not liable for including but not solely limited to any technical failures affecting the participation and/or prize redemption process of the Competition and responsibility is not accepted for entries lost, damaged or delayed as a result of including but not solely limited to any network, computer or cell phone hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
8.7. The Promoters may require the Winner to be identified, photographed, and published in printed media, social media, social digital media channels, or to appear on radio and/or television, without any payment or other remuneration when accepting the Prize. The Winner will be given the opportunity to decline to the publication of their image and to participate in the Promoters’ marketing materials in so far as it relates to the Competition.
8.8. The winner’s name may be announced and published on the Promoter’s social media pages, which includes Facebook, Instagram, Twitter (X) pages. This contest is in no way sponsored, endorsed, administered by or associated with Facebook, Instagram or Twitter. Participants understand that Participants are providing Participants’ information to the Promoters and not to Facebook, Instagram or Twitter.
8.9. The laws of the Republic of South Africa govern these terms and conditions.
